Dispute Resolution, Arbitration, and General Provisions

• Informal Dispute Resolution: Before filing any formal claim against NurMunA LLC, you agree to try to resolve the dispute informally by contacting us at legal@nurmuna.com. We will contact you via email to attempt to resolve the dispute. If a dispute is not resolved within sixty (60) days of submission, you or NurMunA LLC may bring a formal proceeding.
• Binding Arbitration: You and NurMunA LLC agree to resolve any claims relating to these Terms or the website through final and binding arbitration in Austin, Travis County, Texas, except that you or NurMunA LLC may assert claims in small claims court in Travis County, Texas if they qualify. The arbitration shall be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.
• Class Action Waiver: YOU AND NURMUNA LLC AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. This means you waive any right to participate in a class-action lawsuit, class arbitration, or representative action against NurMunA LLC.
• Governing Law & Forum: These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law principles. To the extent any formal litigation is permitted under these Terms (such as to enforce an arbitration award or for small claims), both you and NurMunA LLC consent to the exclusive jurisdiction and venue of the federal and state courts located in Travis County, Texas.
• Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by an arbitrator or court of competent jurisdiction, that provision shall be severed or modified to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.
• Waiver: No waiver of any term or condition of these Terms by NurMunA LLC shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
• Entire Agreement: These Terms constitute the entire agreement between you and NurMunA LLC regarding your access and use of our website, and supersede all prior or contemporaneous communications, agreements, or proposals (whether oral, written, or electronic) regarding the website.
